TERMS & CONDITIONS AGREEMENT

SUMMARY

 

High Adventure Pty Ltd Paragliding and Paramotoring will always work hard to fulfil your training and goals, but sometimes it is best to have a few simple things written down so that we both know what is what.

 

These ‘Terms and Conditions’ apply to all of our courses, tours and equipment sales, please read carefully before enrolling, ordering and paying.


PARAGLIDING AND PARAMOTORING COURSES

COURSE BOOKINGS

 

You can book your place in our courses by checking out through our ‘Online Store’ or via email: learn@highadventure.com.au

 

To secure your place in a course, a deposit must be placed and the course date nominated. Deposits can be made via the ‘online shop’ by PayPal and Direct

 

Debt or arranged by email to be made over the phone with Visa/Mastercard or Direct Debt.

 

HGFA Student Membership must be taken out by any students prior to undertaking their HGFA PG2 licence training. The cost of the insurance is $28 and it not included in the Advertised course fees. From 2016 Students are required to take out the Insurance themselves, rather than the school doing so on their behalf. It also saves time having this done prior to your arrival at the school. The fee is payable directly to the HGFA through their website.

 

The HGFA Student membership is Valid for 12 months.

 

Details on the HGFA Membership, enrolment forms and course information will be emailed to you prior to the course. Generally on receipt of your course deposit.

 

The HGFA Student Membership gives you $20,000,000 ‘Public Liability Insurance’. You need this cover to legally fly in Australia and participate in any training under a licenced Flight (Paragliding and Paramotoring) Training Facility.

 

All students will be required to sign the HGFA ‘Indemnity and Assumption of Risk Waiver’ prior to course participation or tandem flight. This form will be emailed to you before you arrive or you can find it through the HGFA Website.

 

Minimum age is 16 years, (with parent’s consent) to learn to Paraglide

 

The maximum weight for Paragliding Students is 120kg

 

All of our paragliding and paramotoring courses must be completed within 12 months of starting your initial training. After this time ‘Course’ tuition will expire. Please make arrangements with us prior to the 12 months to avoid/extend the course expiry and to avoid paying any additional fees to complete your course.

 

We rely on good weather conditions for the safe progression of an individual’s flight training. The Instructor’s decision to fly or not is final. Certain experiences are subject to weather conditions. If in the event the experience is cancelled due to unsuitable weather conditions, an alternative booking will be made available.


COURSE CANCELLATIONS

 

When you make your booking you are entering into an agreement with us. Please note the cancellation policy before committing to booking a place in our courses.

 

We are a small business, so cancellations can have a big impact on us, especially if we have turned away potential students or closed off courses for people who have already booked and who then cancel. However, we are human, and we understand that plans change and that life gets in the way – and that’s why we offer several options on how to change/cancel your reservation.

 

The appropriate cancellation charge will apply based on the price of your paragliding course, as shown below.

 

If you wish to cancel your scheduled course, a minimum of 30 days notice applies prior to start date.

 

In the event of a cancellation up to 30 days prior to the scheduled date, we will offer you a full refund.

 

If you cancel your reservation within 29 days before of the scheduled course training date, you will forfeit your deposit. You are also welcome to transfer to another course date.

 

If you cancel within 14 days of the course training date, a cancellation charge of 25% of total price will be charged. You are also welcome to transfer to another course date.

 

If you cancel your reservation within 7 days of the scheduled course, a cancellation charge of 50% of total price will be made. Please discuss the option of moving to another course date.

 

If you do not cancel, but you fail to arrive without notification, you agree that 50% of the total price be charged.

 

You are welcome to move your training dates. We ask that you do this at least 2 weeks prior to your course training so that we can open your position up to other students. Anything after that will be on a case by case basis. Again we are human (also parents), so we understand that things HAPPEN! Please keep in contact with us should anything come up that looks like it may prevent you from coming. Thanks for your understanding.

 

All requests for cancellations must be received in writing by email at learn@Highadventure.com.au. We will acknowledge receipt of your cancellation by return email. If you are at all concerned, please call Johanna on 0409221974.

 

TANDEM PARAGLIDING EXPERIENCE

 

Paragliding is a weather dependent activity. If it’s cancelled due to bad weather, you can arrange to complete the flight at another time.

 

Minimum age to take a ‘Tandem’ joy flight is fly is 14 years – with parent’s signed consent.

 

A ‘HGFA Assumption of Risk Waiver’ form must be signed prior to undertaking a tandem flight joy flight (Otherwise known as Instructional flight for Insurance reasons). This will be provided to you in hard copy when you meet with us and can be signed then. If you would like to sign it ahead of time, please bring this with you. Thanks.

 

Tandem paraglider flights, and gift vouchers are valid for 12 months from the date of purchase.

 

Tandem flights and vouchers will expire after 12 months from the date of purchase. If you are unable to take the flight during the 12 months, please make arrangements prior to the voucher expiry.

 

Pre-purchased tandem paraglider flights and gift vouchers do not have a cash value. This means that they cannot be redeemed for cash.

 

There are no refunds for ‘Gift Vouchers’. We will allow ‘Gift Vouchers’ to be transferred, but you must let us know the name and voucher number etc.

LEARN TO PARAGLIDE BALI – OVERSEAS TRAINING

 

DEPOSIT REQUIREMENTS

 

You are required to pay a non-refundable deposit of $220 per person for your booking to be confirmed. If your booking is made within 30 days of the departure date then the full amount is payable at the time of booking.

 

We do not take full payments until July. Only deposits are taken to secure positions.

 

If you need to cancel your position in the Bali Course, you are able to transfer the deposit to a course in Australia provided you make this request before the 15th of June 2016.

 

ACCEPTANCE OF BOOKING AND FINAL PAYMENTS 

 

If we accept your booking we will issue a confirmation invoice. A contract will exist between us from the date we issue the confirmation invoice or if you book within 30 days of departure the contract will exist when we accept your full payment. Please refer to your booking confirmation invoice for details regarding final payments.

 

Payment of the balance of the trip price is due 30 days before the departure date. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled. Please discuss any problems regarding payment if they should arise.

 

INSURANCE 

 

Travel Insurance is compulsory  for all students undertaking the Learn to Paraglide course in Bali. Its important that that you take out comprehensive insurance cover for cancellation, personal injury, death, medical expenses, repatriation expenses and evacuation expenses before you travel to Bali for the course. We strongly recommend your insurance also covers cancellation, personal liability and loss of personal property, curtailment and personal effects.

 

Please check that the insurance covers all of the activities that you are going to be participating in. Some policies exclude certain adventure activities.

 

Insurance should be arranged at the time of payment of the deposit and will, in certain circumstances, cover you against loss of deposit or cancellation fees from the date of confirmation of your booking, as shown in the insurance policy. High Adventure cannot be held responsible for your failure to take out appropriate insurance. You also agree to indemnify us against all third-party claims, actions, damages and remedies which may be brought against us in respect of your participation in the holiday.

 

If you have credit card insurance you will require to supply details of the participating insurer/underwriter, the level of coverage, policy number and emergency contact number rather than the bank’s name and credit card details. Please contact your bank for these details prior to arriving in-country.

 

Courses run by High Adventure Pty Ltd are covered by the HGFA Liability insurance, but please note that they do not cover any accident or medical insurance. Getting medical insurance is easy and cheap – We are more than happy to make suggestions to you for a travel insurer that covers Paragliding such as CoverMore or Australia Post etc. If you require help, please let us know.

 

You must also be a member of the Hang Gliding federation of Australia by way of a ‘Restricted Student Membership’ before undertaking any training overseas (Bali). This is the same process as if you were training in Australia. This costs $28 and membership should be completed just before you depart. This is not covered in the Course fee and is payable to the HGFA.

 

All students must fill out the ‘HGFA Assumption of Risk waiver‘, details of this along with other details will be emailed to you prior to the Bali trip.

 

If you are not an Australian Citizen and are undertaking training with High Adventure overseas (Bali) please discuss with me your requirements.

 

Paragliding training completed overseas, with an outset to become a Licenced Pilot under the HGFA, must be completed within 12 months of the initial training.

 

IMPORTANT INFORMATION REGARDING LEARN TO PARAGLIDE BALI

 

All students who are traveling to Bali to undertake the the Learn to Paraglide Bali course will need to return to Laurieton (Mid North Coast of New South Wales) to complete their ‘Restricted’ Pilots Licence. We are unable to conduct high flights in Bali, these skills will need to be assessed at our Training base. If you are unable to return to Laurieton, we can try and arrange a future sign off with another training facility local to you, but this cannot be guaranteed. Please discuss this with me if you need clarification. We should not that unfortunately we cannot be responsible for any daily fees you may need to pay to the other Training facilities to get signed off. Generally, $250 – $500 depending on how long you leave it and your individual skill set.

 

Learning to Paraglide requires a certain set of skills, if you first learn these and leave it 12 months before you use them again, you can be sure that you will have forgotten them or require some time to brush up on them again. Be realistic about the time you will need between training. If its been 10 months, you may need more than just a few days. If you keep your skills fresh, you will only need a few days back in Australia to finish off your course.

 

LEARN TO PARAGLIDE BALI COURSE INCLUSONS + EXCLUSIONS

 

Inclusions
The land price of your trip includes:

  • All training with High Adventure Pty Ltd both in Bali and Australia
  • All transport to the flying sites from the Santika Siligita in Nusa Dua
  • All equipment (Wing, Harness, Radio etc)
  • Tour T-Shirt (Short or Long Sleeves)
  • Classroom tuition and coaching
  • $400 Credit Voucher to be used for ‘Paragliding Gear Set up’ should you wish to use it. See Terms + Cond for use of Credit

 

Exclusions
The land price of your trip does not include:

  • International flights
  • Accommodation and meals
  • Airport transfers, taxes and excess baggage charges
  • Visa and passport fees
  • Travel insurance
  • Optional activities and all personal expenses
  • HGFA membership ($28.00)  payable to the HGFA

 

ALTERNATIVE ACTIVITIES

 

Whilst in Bali there are a number of alternative activities may be available during the time of your course, including motor bikes, water sports, snorkelling, swimming etc. and other sports not mentioned that involve an inherent element of risk. Apart from paragliding, all such activities are provided not by High Adventure but by local individuals and businesses who are solely responsible for all aspects of your safety and participation in the activity concerned. High Adventure Pty Ltd and all of their instructors and employees hold no responsibility for any of the aforementioned activities or any incidents that take place relevant to them.

 

Please note that for our Overseas trips you must take adequate cancellation and travel insurance at the time of booking.

 

CANCELLATIONS FOR STUDENTS LEARNING TO PARAGLIDE IN BALI

 

CANCELLATION BY THE STUDENT 

 

We are a small business, so cancellations can have a big impact on us, especially if we have turned away potential students or closed off courses for people who has already booked and who then cancel. Bali is an extremely popular course and fills quickly. It also take a lot of administration work per student, fees payable to government and regulatory bodies, membership applications etc. If you cancel your spot after the 1st of July, you will not receive a refund. You will need to claim the cancellation against your travel insurance. We are incredibly sorry about this – but we’ve been caught out so many times being the ‘good guy’ that now we’ve had to be firm across the board. If you need to chat about his, please do call us. We’re a friendly bunch, even if this seems a little harsh!

 

ALTERNATIVELY: If you are unsure if you want to commit to the course and don’t want to lose a deposit – that’s fine. We can write you in the diary and inform you when the very last position (or last positions in that course) are left. No commitment and no deposit lost. We can’t guarantee anything though, so do keep that in mind. Email me at learn@highadventure.com.au if would like me to do this for you.
If we haven’t already stressed it, here it is – You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees. If you leave a trip for any reason after it has commenced, we are not obliged to make any refunds for unused services.
If you fail to join a course, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation fees are in addition to fees which may be levied by operational staff, accommodation providers, travel agents or third party tour and transport operator fees.

CANCELATION BY HIGH ADVENTURE 

 

We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not safe for us to operate the planned itinerary.

 

If we cancel your trip, you can transfer amounts paid to an alternate departure date or alternatively to an Australian based course.  We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

 

You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees. If the reason for cancellation falls within the terms of any holiday insurance policy which you hold, then any such charges may, subject to the terms of your insurance policy, be refunded to you by the insurance company.

 

FORCE MAJEURE 

 

High Adventure Pty Ltd will not be liable for any breach of contract due to any matter or thing beyond the Company’s control – including but not limited to transport stoppages, transport breakdown, fire, flood, earthquake, volcanic eruptions, acts of God, strikes, lock-outs, work stoppages, wars, riots or civil commotion, intervention or public authority, explosion or accident.

 

We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, travel insurance excess or non-refundable flights.

 

You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees.

 

WEATHER CONDITIONS AND INTERRUPTIONS TO TRAINING

 

We choose the travel to Bali annually because of the weather, but of course as with any activity dependent on Nature, there are risks of strong winds or other unsuitable weather conditions and High Adventure Pty Ltd. reserves the right to cancel flying at any time. Please be sure that you fully understand this.

 

BALI – ADVANCED TOUR + NUSA DUA TOUR

Our General Bali tour is operated for qualified paragliding pilots. In booking with High Adventure to attend the Bali tour, you certify and warrant that you are a qualified and competent person suitable for the tour which you are taking and the evaluation of such advice.  Paragliding mentorship is provided on an advisory basis only and is not paragliding instruction. You are expected to take independent decisions in the air and on the ground, including, but not limited to, your own suitability assessment and decision to fly, including, but not limited to, evaluation of guidance related to SIV manoeuvres.

 

You will provide your own appropriate and well maintained equipment. You must not fly under the influence of alcohol, drugs or debilitating medication. By your independence you are solely responsible for any loss or damage that you may cause to yourself and third parties such as, but not limited to, other clients of High Adventure Pty Ltd Paragliding and other parties that may be sharing the sites at which we fly. High Adventure Pty Ltd and its employees against any such liability.

 

PILOT SUITABILITY

 

Paragliding is a physically active sport suitable for the reasonably fit with no particular health, eyesight or hearing problems and the mental ability to accept guidance.  You should satisfy yourself that you are physically able and mentally suitable for attending a paragliding tour in conditions that may be foreign to you – culturally and environmentally. If you have any doubt at all as to your suitability, you should seek general and medical advice prior to booking.

 

Upon booking the Advanced Tour to Candi Dasa and the General Tour to Nusa Dua, you (the pilot) agree that you are physically and mentally suitable for the tour  and indemnify High Adventure Paragliding and its staff against any claim for loss, injury or fatality as a result of such unsuitability, whether disclosed or not.

 

RIGHT OF REFUSAL

 

You accept that High Adventure Paragliding reserves the right to refuse to guide or otherwise assist you in any way whatsoever, whether temporarily or permanently, at any time, as it sees fit in its sole discretion, without refund.

 

WEATHER AND LOCAL RULES 

 

Paragliding is a weather dependent activity. In areas in which we operate, permission to fly may also be withdrawn by local authorities or flying sites might unavailable for reasons beyond our control. You accept that flying may be disrupted, limited, or may not be available at all.

PAYMENT OPTIONS FOR OVERSEAS COURSES

 

All prices quoted for training, unless otherwise stated, are exclusive of GST and are not subject to GST.

 

We accept payment by Cash, Visa, Mastercard, Direct Debt and PayPal.

 

When providing your credit or debit card details you are agreeing that you are authorised to use that card and it must have sufficient available funds to cover your charges.

 

A surcharge of 2.6% is applicable for payments made with a credit cards.

A surcharge of 2.6% is applied for payments made with PayPal

No Surcharge applies to payments made by Direct Debt

 

Full payment will be required in July. We will invoice you, and you can pay the method that suits you best. Direct Debit, Visa/Mastercard, PayPal etc.

 

Once full course fees have been paid, it will not be refunded on cancelation. Course fees can be transferred to an Australian based training course date and used as a credit against the Australian based Course fee. If you have a good reason, medical issues etc, please do contact us. We will assess this on a case by case basis.

 

Please note that for our Overseas trips you must take adequate cancellation and travel insurance at the time of booking.

 

GENERAL HIGH ADVENTURE INFORMATION

CREDIT VOUCHERS – COURSE CREDITS 

 

LEARN TO PARAGLIDE $400 CREDIT

 

Any student booking a Learn to Paraglide course in Australia or a  learn to Paraglide in Bali course with High Adventure is entitled to a $400 Credit voucher. This credit voucher is redeemable against the purchases of a ‘Paragliding Gear Set’. A paragliding Gear set consists of 1 (one) new Paraglider and 1 (one) new Harness.

 

The gear can be purchased prior to undertaking your training and used as the students ‘Personal’ training kit during training. If the Glider and Harness are purchased after completion of the course, then equipment will be provided by High Adventure during the students training and charged as advertised.

 

With the exception of combining with the 10% GST rebate issued at the Airport on departure (for Students undertaking training in Bali), the $400 Discount may not be combined with any other offers, discounts or gift vouchers.

 

The $400 discount cannot be accumulated or applied retroactively to previously placed orders/courses unless otherwise agreed.

 

Discounts apply to the product value and exclude the delivery charge for gliders and harnesses.

 

Different ‘discounts’ cannot be added in a single purchase. A single discount is applied to each purchase. Only one $400 discount may be used per ‘Paraglider Gear Set’. A paragliding Gear set consists of 1 (one) new Paraglider and 1 (one) new Harness.

 

Discounts may not be redeemed for cash or transferred.

 

The $400 credit cannot be redeemed to buy a sole product even if the price of the single product is greater than “Paragliding Gear Kit”

 

If you have other discount vouchers – the single highest discount applies (discounts are exclusive of each other and cannot be accumulated).

 

Different Vouchers cannot be added in a single purchase. A single voucher is applied to each purchase.

 

Any Free add-ons that may be offered during the Bali course – such as ‘tandem experience flights (for) partners’ for are not redeemable as cash or credit. They are not transferable. Only one ‘Partner’ Tandem Experience per person.

 

 

VOUCHERS DONATED BY HIGH ADVENTURE FOR CHAIRITY FUNDRAISING EVENTS

 

High Adventure  donates upward of $10,000 in ‘Vouchers’ annually that are used for fundraising purposes. We need to stipulate that multiple vouchers cannot be bought at ‘Auction’ or otherwise at significantly reduced RRP value and combined. Please let us be clear – You cannot purchase multiple vouchers and add them together.

 

Vouchers holders are also not entitled to any further ‘Discounts’. Additional discounts will be at the discretion of the owners of High Adventure.

 

Vouchers cannot be used in conjunction with other ‘Deals’, ‘Specials’ or promotional items. Vouchers do not have a cash value and cannot be redeemed for cash. We are more than happy for vouchers to be transferred, but please do let us know. Vouchers expire 12 months from the auction in which they were used. Thanks for your understanding on this!

Yes, we are able to offer group discounts. Please contact us regarding this.

 

BALI

Sorry we are unable to offer discounts for multiple bookings? For us to operate in Bali we take staff (lot of staff) we have considerable costs such as transportation, equipment, flights, excess baggage for equipment, local taxes, local federation fees and flights. The list is endless. We have created a price that is reasonable for everyone. We hope that you understand this. We can offer you discounts on gear that will exceed the $400 is your group would like to purchase equipment.

 

PRICING

Prices are subject to change without notice. If you have booked a course – you have booked on that price and it is NOT subject to change.

All prices quoted are GST Inclusive.

Courses conducted outside of Australia are not subject to GST.

Products exported to international clients are GST exempt.
